Medical Expert Witness

Every day, many medical malpractice lawsuits are decided on the testimony of a medical expert witness. Unlike regular lawsuits, the facts in a malpractice suit need to be carefully looked over and have to be accurate in order of the judge to make the right ruling. Unfortunately, in many states the success rates of plaintiffs who win these lawsuits are very low. Medical malpractice is essentially a medical or healthcare provider who has not followed the correct procedures or who has failed to provide the correct medical care to a patient. The main reason for many of these lawsuits is that the patient was injured or disabled after a negligent surgeon or doctor attended to the patient. These cases can also pertain to doctors and nurses who mistreat patients and who do not give them the care and attention they need.

One of the more serious medical malpractices cases are cases that are related to the wrongful death of a patient whose life could otherwise have been saved or spared. By having a medical expert witness who has analyzed your case and found that there was in fact malpractice by your side in court, you will have a much stronger case and greatly increased chance of winning the lawsuit. Such a lawsuit can be filed by the patient themselves; however, if the patient is incapacitated due to the malpractice, or if it is a wrongful death suit, the patient can be represented by anyone who has the right to legally defend said patient in court. In the majority of these cases the legal representative will usually be the next of kin or a relative of the patient but can even be the patient's executor of estate if the patient passed away.

Even though there are many well-educated and experienced attorneys who specialize in medical malpractice lawsuits, they do not count as a medical expert witness. An expert witness is usually a doctor or other medical expert who will be able to determine if there was, in fact, any malpractice. In many cases, the malpractice did not leave any physical evidence; however, the patient can be evaluated to see if they suffered from psychological trauma.

A medical malpractice has many loop holes and that is why it is absolutely important to have a medical expert witness on your side.
